Spanish Judges Opt to Annul IRPH-Indexed Mortgages following the Ruling from Europe

The ruling from the Court of Justice of the European Union in March has reactivated the causes that had been suspended pending the verdict from Luxembourg.

After Europe left the annulment of IRPH-indexed mortgages in the hands of Spanish magistrates more than a month ago, several courts have ordered the replacement of the IRPH element with the more frequent ‘Euribor plus a differential’ formula, since it is the most beneficial for the consumer, according to reports by Efe.

The ruling from the Court of Justice of the European Union (EUCJ), which in March opened the door for national judges to analyse whether entities had commercialised the IRPH option transparently, on a case-by-case basis, has reactivated the causes that had been suspended pending the verdict from Luxembourg.
